Terms of Service
Last updated: October 24, 2026
Please read these Terms carefully. They include an agreement to resolve disputes through individual arbitration and a waiver of class actions and jury trials (see Section 11), which you can opt out of within 30 days. If you do not agree to these Terms, do not use Atomic Anesthesia.
1. Acceptance of these Terms
These Terms of Service ("Terms") are a binding agreement between you and Atomic Anesthesia, LLC ("Atomic Anesthesia," "we," "us," or "our"). They govern your use of atomicanesthesia.com, our web application, and related services, including lessons, the question bank, flashcards, the Voice Preceptor, the case log, the media hub, community forums, direct messages, events, and emails (together, the "Service").
By creating an account, starting a trial, making a purchase, or otherwise using the Service, you agree to these Terms and to the policies they reference, including our Privacy Policy, Acceptable Use Policy, and Cookie Policy.
Atomic Anesthesia is an educational platform for student registered nurse anesthetists (SRNAs), nurse anesthesia faculty, and related learners.
2. Accounts and eligibility
2.1 Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. You may not use the Service if you are barred from doing so under applicable law, are located in a country subject to U.S. embargo, or appear on a U.S. government list of prohibited or restricted parties.
2.2 Your account
Give accurate information when you sign up and keep it current. Your account is for you alone: do not share your login or let anyone else use your membership. You are responsible for activity under your account and for keeping your credentials secure. Tell us right away at hello@atomicanesthesia.com if you think someone else has accessed it.
2.3 Your representations
By using the Service, you confirm that:
- The information you provide is accurate and you have the right to provide it
- You will use the Service only for lawful, personal educational purposes
- You have the rights to any content you post or upload, and it does not infringe anyone else's rights
- You will not misrepresent your identity, credentials, school, or professional role
3. Educational use only
Atomic Anesthesia does not provide medical advice. All content is for education and exam preparation. It is not a substitute for your program's curriculum, your clinical instructors and preceptors, your institution's policies and protocols, drug labeling, or professional clinical judgment.
3.1 Clinical content
Anesthesia practice, drug information, and guidelines change. We work to keep content accurate and current, but we do not guarantee that any lesson, question, flashcard, audio, video, or AI-generated output is complete, current, or error-free. Never use the Service to make decisions about the care of a real patient. Always verify clinical information against authoritative sources and follow the supervision and protocols that apply to you.
3.2 No guarantee of results
We do not guarantee that you will pass any course, program requirement, the Self Evaluation Examination (SEE), the National Certification Examination (NCE), or any other exam. Scores, progress metrics, streaks, readiness indicators, and recommendations are study tools, not predictions. Atomic Anesthesia is not affiliated with or endorsed by the NBCRNA, the COA, the AANA, or any nurse anesthesia program unless we say so expressly.
3.3 Emergencies
The Service is not for emergencies. If you or someone else needs emergency care, call 911 or your local emergency number.
4. Memberships, trials, billing and refunds
Automatic renewal. Memberships renew automatically until you cancel. Premium costs $15 per month or $150 per year, plus any applicable tax. An eligible 3-day free trial requires a card and converts to the $15 per month membership when the trial ends unless you cancel before then. You can cancel online at any time in Settings → Subscription.
4.1 Plans
- Free account: limited access. Premium content appears locked or previewed.
- Premium monthly: full access for $15 per month, billed in advance each month.
- Premium annual: full access for $150 per year, billed in advance each year.
- 3-day free trial: full Premium access for 3 days for eligible new members, then $15 per month unless canceled before the trial ends.
- Courses: some courses, such as the Cardiac Pharmacology course, are sold separately as one-time purchases and include ongoing access to that course for as long as we offer the Service.
The price, billing interval, and any trial terms are shown before you pay. Promotional or legacy pricing applies only as stated when you accepted it.
4.2 Billing and authorization
Payments are processed by Stripe. When you start a trial or buy a membership, you authorize Atomic Anesthesia and Stripe to charge your payment method the price shown, at the frequency and on the dates shown, plus applicable taxes, until you cancel. We do not receive or store your full card number. Keep your email address and payment details current. If a renewal payment fails, we may retry it and may pause Premium access until the balance is paid.
4.3 Free trials
You will not be charged when an eligible trial begins. Unless you cancel before the trial ends, Stripe will charge $15 per month when the trial ends and every month after that until you cancel. The trial end date and first charge date are shown at checkout and in your account. Trials are limited to one per person and account, and are not available to current or former members. If the first charge after a trial fails, Premium access stops until you update your card.
4.4 Switching to annual
If you switch from monthly to annual billing in Settings, the confirmation screen shows the amount and when it will be charged before you authorize it. The annual membership then renews each year at the annual price shown unless you cancel. Where required by law, we will send you a reminder before an annual membership renews.
4.5 Cancellation
You can cancel any time in Settings → Subscription, where you can also open the Stripe billing portal to update your card or see invoices. If you can't reach either, email hello@atomicanesthesia.com from the address on your account and we will cancel for you. Cancel before a trial ends to avoid the first charge. After a paid period starts, canceling stops future renewals and you keep Premium access until the end of the period you paid for. Your account, progress, notes, and decks are kept on the free plan. You must cancel your membership before you can delete your account.
4.6 Refunds
Membership fees and one-time course purchases are non-refundable, and we do not give prorated refunds for partial billing periods, except as required by law. If you were charged by mistake or forgot to cancel, email hello@atomicanesthesia.com within 7 days of the charge and we will review your request. If a payment is refunded or reversed, access purchased with it ends. Nothing in these Terms limits a refund right you have under applicable law.
4.7 Price changes
We may change prices. We will give you advance notice of a price change to your membership and an opportunity to cancel before it takes effect. A new price applies from your next renewal after the notice period.
5. Privacy
Our Privacy Policy explains what personal information we collect, how we use it, which service providers (including AI providers) process it, how long we keep it, and the choices and rights you have. Our Cookie Policy explains cookies and similar technologies. We do not sell your personal information.
6. Patient information
Never enter information that identifies, or could reasonably identify, a patient anywhere in the Service. The Service is not a clinical record system and is not designed to store protected health information.
This applies to the case log, Voice Preceptor sessions, forum posts, direct messages, uploads, notes, and flashcards. Do not include:
- Names, initials, addresses, phone numbers, or email addresses of patients or their families
- Medical record numbers, account numbers, or other identifiers
- Photos, images, or recordings of patients or their records
- Exact dates of birth, admission, surgery, or discharge tied to a patient
- Any combination of details (rare condition, facility, date, age) that could identify someone
Log cases in general terms (for example, "ASA 3 adult, laparoscopic cholecystectomy"), and follow your program's and clinical sites' confidentiality rules. If we find patient-identifying information, we may remove it and may suspend or close the account involved. You remain responsible for your own professional and legal confidentiality obligations.
7. Your content and the community
7.1 Your content
You own the content you create, such as forum posts, replies, direct messages, personal flashcards and decks, case log entries, and profile details ("User Content"). You grant Atomic Anesthesia a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and adapt your User Content as needed to operate, provide, and improve the Service. For content you share with other members, such as community posts, this license lets us keep displaying it as part of the discussion after you leave, shown as from "Deleted User" if you delete your account.
7.2 Community rules
You must follow our Acceptable Use Policy. You are responsible for what you post. We do not verify or endorse User Content, and advice from other members is not professional advice.
7.3 Moderation
We may, but are not required to, review, hide, edit, or remove content, and suspend or close accounts that violate these Terms or our policies. Where reasonable, we will tell you why. Report a concern with the in-app report button or by email.
8. AI features
Some features, including the Voice Preceptor and AI flashcard generation, use third-party AI models. Our Privacy Policy explains what is sent to which provider. AI output can be wrong, incomplete, or out of date, even when it sounds confident. Check it against your course materials and authoritative sources, and never use it to make decisions about patient care. Only upload or paste material you have the right to use, and do not include patient information.
9. Intellectual property
9.1 Our content
The Service and its content, including lessons, questions and explanations, flashcard decks, audio, video, worksheets, illustrations, software, and the Atomic Anesthesia name and logo, are owned by Atomic Anesthesia or its licensors and protected by copyright, trademark, and other laws.
9.2 Your license
While your account is in good standing, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access the content available to your plan for your own non-commercial study. You may download worksheets and other files we offer for download for your personal use.
9.3 What you may not do
- Copy, record, screenshot in bulk, scrape, download, or export content beyond the features we provide
- Share, sell, publish, or post our content, including questions and explanations, anywhere outside the Service
- Use our content to build a competing product, question bank, course, or dataset, or to train AI models
- Remove copyright or other notices
Copyright complaints are handled under our Copyright (DMCA) Policy.
9.4 Feedback
If you send us suggestions or report question errors, we may use them without any obligation to you.
10. Disclaimers and limitation of liability
10.1 Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
10.2 Limitation of liability
To the fullest extent permitted by law, Atomic Anesthesia and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or opportunities, arising out of or relating to the Service or these Terms. Our total liability for any claim will not exceed the greater of the amount you paid us in the 12 months before the claim or one hundred U.S. dollars ($100).
Some jurisdictions do not allow certain warranty exclusions or liability limits, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
10.3 Indemnification
You agree to indemnify and hold Atomic Anesthesia harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising from your User Content, your misuse of the Service, or your violation of these Terms, the law, or someone else's rights.
11. Dispute resolution and arbitration
Please read this section carefully. It affects your legal rights. Unless you opt out under Section 11.5, you and Atomic Anesthesia agree to resolve disputes through binding individual arbitration and waive the right to a jury trial and to take part in a class action.
11.1 Try to resolve it informally first
Before starting arbitration, the party with the dispute must email a written description of the claim and the relief requested (to us at hello@atomicanesthesia.com, or to you at your account email). We will both try in good faith to resolve it within 30 days.
11.2 Agreement to arbitrate
Any dispute arising out of or relating to these Terms or the Service that is not resolved informally will be resolved by final and binding individual arbitration, except that either party may bring an individual claim in small claims court, and either party may seek an injunction in court to stop actual or threatened infringement or misuse of intellectual property.
11.3 How arbitration works
The American Arbitration Association (AAA) will administer the arbitration under its Consumer Arbitration Rules, including its rules on fees. A single arbitrator will decide the dispute, and the arbitration may take place by video, phone, written submissions, or at a location reasonably convenient to you. The arbitrator may award the same individual relief a court could, and judgment on the award may be entered in any court with jurisdiction.
11.4 Jury trial and class action waiver
To the fullest extent permitted by law, you and Atomic Anesthesia each waive the right to a jury trial, and each may bring claims only in an individual capacity, not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding.
11.5 Opting out
You can opt out of Sections 11.1 through 11.4 by emailing hello@atomicanesthesia.com within 30 days after you first accept this version of the Terms. Include your name, your account email, and a clear statement that you opt out of arbitration. Opting out does not affect the rest of these Terms.
11.6 Governing law and courts
These Terms are governed by the laws of the State of Delaware and applicable U.S. federal law, without regard to conflict-of-law rules. Any claim not subject to arbitration or small claims court must be brought exclusively in the state courts located in the State of Delaware or the United States District Court for the District of Delaware. This does not remove any non-waivable rights you have under the laws of the place where you live.
12. Third-party services
The Service links to or embeds services we don't control, such as Stripe checkout, Vimeo video, event links (for example, Zoom), and external articles and references. Their own terms and privacy policies apply, and we are not responsible for their content or availability.
13. Changes to the Service and these Terms
We regularly add, change, and retire content and features. We may also update these Terms. When we do, we will post the new version and update the date above. For material changes, including changes to automatic-renewal terms, we will give you advance notice by email or in the Service. If you don't agree to the changes, stop using the Service and cancel your membership before it renews. Continuing to use the Service after the changes take effect means you accept them.
14. General terms
14.1 Suspension and termination
You may stop using the Service and delete your account at any time from Settings → Privacy & security. We may suspend or close your account if you violate these Terms or our policies, if required by law, or to protect the Service or other members. If we close your account without cause, we will refund any prepaid fees for the unused period. Sections that by their nature should survive termination (including Sections 3, 6, 7.1, 9, 10, and 11) will survive.
14.2 Electronic communications
You agree that we may send you notices, receipts, and other communications electronically, and that they satisfy any requirement that they be in writing. You can unsubscribe from marketing emails at any time; account and transactional emails will continue while you have an account.
14.3 Other terms
These Terms and the policies they reference are the entire agreement between you and Atomic Anesthesia about the Service. If any provision is found unenforceable, it will be limited to the minimum extent necessary and the rest will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control. Headings are for convenience only. You agree to comply with applicable U.S. export control and sanctions laws.
